Terms and Conditions

This document, titled General Terms and Conditions (hereinafter referred to as "GTC"), governs the legal relationship between Varga Laura (hereinafter referred to as "Organizer"), businesses involved in the execution of the contract, and individuals purchasing the online educational materials (digital product, knowledge base) organized and sold by the Organizer (hereinafter referred to as "User").

Scope and Publication of the GTC

The provisions of this GTC apply to all contracts concluded after its effective date and comprehensively regulate the rights and obligations of the Organizer and the User.

The User accepts and acknowledges the provisions of the GTC as binding during the application process.

The provisions of this GTC shall apply in all cases not specifically regulated by an individual contract between the Organizer and the User. The Organizer reserves the right to enter into individual contracts that deviate from the terms of this GTC.

The GTC is published on the https://tressart.com website, making it accessible and available to all parties. Users cannot claim ignorance of its content.

The interpretation of the GTC must always align with applicable laws. Any matters not regulated by the GTC shall be governed by Hungarian law, particularly the legal regulations outlined in this document.

The Organizer has the right to unilaterally amend the GTC. The amended GTC will be published on the https://tressart.com website, and users with an active contract will be notified of the changes via email by the training institution.

General Information Regarding the Online Educational Materials

The program and content of other online educational materials announced by the Organizer are regulated and determined solely by the training program, curriculum, and methodology established by the Organizer. These programs do not fall under the scope of Act LXXVII of 2013 on Adult Education.

No prior qualifications or prerequisites are required to apply for the online educational materials. Users can educate themselves using videos, text-based, and other materials at their own pace, according to their abilities. These educational materials do not conclude with an exam or knowledge assessment, nor are they designed for structured, goal-oriented competence development or classified as formal education. However, Users have the opportunity to showcase their acquired knowledge within a controlled framework in a dedicated private Facebook group.

The content of the educational materials is developed by a qualified expert with the highest level of professional knowledge in the respective field.

Users have unlimited access to the content of the digital product. Exceptions apply to offers announced through various marketing campaigns (e.g., time-limited access to specific course materials).

Users are not authorized to download the content.

Users are entitled to request all necessary information and technical details regarding online access to the educational materials via email.

Application and Contract Formation

Users can apply for the online educational materials by filling out and submitting the application form online. During registration and purchase, Users must accept the present GTC if they wish to acquire the educational material. By selecting the checkbox to accept the GTC, a contract is formed between the Organizer and the User under the terms outlined in this document.

The User pays for the ordered service online through a payment interface provided by WooPayments and Stripe. During payment, the User is redirected to the payment page, where they can enter their bank card details to initiate the transaction. After entering the card details, their accuracy must be verified. The transaction is processed, and the User receives an email notification regarding the payment result from the banking system.

Based on the information provided in the confirmation (username and password), the User can access the online educational material within the authorized period, subject to copy protection.

The contract between the parties is concluded in English (???).

User Rights and Obligations

By accepting the Terms and Conditions (GTC) and applying, the User commits to paying the fee for the ordered online educational material. This fee is listed on the website along with general information.

The User is entitled to access the content of the online educational material during the specified access period. Information regarding the duration, scheduling, and availability for download of the educational material is separately provided on the website for each case.

The User acknowledges that the information obtained under this contract may only be used for personal purposes and may not be shared with, disclosed to, or made accessible to any third party.

The User has the right to submit a complaint within 8 days from the occurrence of the issue. Complaints must be submitted in writing, including the User’s name and address, to the Organizer's institution. The Organizer will document the complaint and conduct an investigation within 30 days, providing a written response with the results.

Before placing an order or applying, every User can review the complaint handling process within this GTC. If a complaint is found to be justified, the Organizer may offer additional online educational materials, provide a discount, or reduce the fee for future materials.

The User must keep their username and password secure. This information must not be shared with or made accessible to third parties. If the User violates this obligation and intentionally or negligently allows third-party access, they will be liable for any resulting damages. In such cases, the Organizer reserves the right to terminate the contract with immediate effect.

The User acknowledges that all theoretical and practical information related to the online educational material is considered a trade secret. Unauthorized acquisition, use, sharing, or disclosure of trade secrets for personal gain or causing financial harm to others is a punishable offense. The User assumes full civil and criminal liability for damages resulting from breaches of trade secrets, reputational harm, or unauthorized publication of content harmful to the Organizer on social media.

A trade secret includes any fact, information, solution, or data related to economic activities whose disclosure, unauthorized acquisition, or use would harm or endanger the rightful owner’s financial, economic, or market interests, and for which necessary confidentiality measures have been taken.

If a User's trade secret rights are violated, they may pursue the following legal claims:

  • Request a court ruling acknowledging the violation.
  • Demand cessation of the violation and prohibition of further breaches.
  • Require the violator to issue a public statement or take corrective actions at their own expense.
  • Seek restoration of the previous lawful state, destruction of the infringing content, or its modification to remove the infringement.
  • Claim compensation for damages in accordance with civil liability regulations.

The User acknowledges that defamation includes making or spreading false statements that harm another person's reputation, or presenting true information in a misleading manner. Defamation has both civil and criminal legal consequences. The Organizer will take all necessary legal actions to protect its reputation against unlawful attacks.

All online materials, presentations, videos, audio files, and their components provided under this contract are protected by copyright, with the Organizer as the rights holder. Any use beyond personal purposes, such as redistribution, resale, publication, or commercial use, is strictly prohibited. The User acknowledges that the Organizer grants only a limited-time usage right to the online educational content, while retaining all other rights. The Organizer informs the User within this GTC that the full content of the online educational material is protected by copyright.

Organizer's Rights and Obligations

The Organizer is obligated to ensure access to the content of the online educational materials for the entire duration of the service and is responsible for the continuous and proper operation of the content service.

If the service becomes unusable due to a reason attributable to the Organizer, the access period will be extended accordingly. In case of an error caused by the Organizer, they will ensure that the issue is resolved as soon as possible.

The Organizer is not liable for errors resulting from events beyond their control.

The Organizer is entitled to receive the fee even if the User has been granted access to the educational material but chooses not to use or view it.

The Organizer is responsible for ensuring that the educational materials are delivered at a high professional standard. However, the Organizer does not guarantee that participation in the online educational program will provide the User with financial benefits, a specific professional qualification, or a trade. The Organizer excludes all liability in this regard. The Organizer limits any compensation claims—except in cases of intentional misconduct, damage to life, physical integrity, or health—to the amount of the fee paid for the online educational material.

The Organizer is obligated to issue a Certificate of Participation to the User who has purchased the online educational material. This certificate will be sent via email after the User has demonstrably completed and mastered the material.

The Organizer is entitled to enforce all rights related to copyright infringement, business secrecy violations, and damage to reputation as defined in these Terms and Conditions.


Termination of the Contract and Refund Policy

Any declaration aimed at terminating the contract is only valid in writing.

According to Section 20 (2) (b) of Government Decree 45/2014 (II.26.), the User has the right to withdraw from or terminate the contract within 14 days from the date of conclusion without providing a reason, provided that it can be proven that the User has not started using or learning the digital content.

If the User has demonstrably started accessing the educational material—by watching, listening to, or engaging with the digital content—they forfeit their right to withdrawal and termination.

If the User wishes to exercise this right, they must submit a clear written statement (via email or postal mail) indicating their intent to withdraw or terminate the contract. The statement must be sent to the Organizer using one of the provided contact details. The User exercises their right within the deadline if the statement is sent before the 14-day period expires.

If the User withdraws from the contract, the Organizer will promptly, but no later than 14 days after receiving the withdrawal statement, refund the full amount paid by the User.

The contract is terminated if the Organizer ceases to exist without a legal successor, in case of the User’s death or legal dissolution, or by mutual agreement of the parties.

Either party has the right to terminate the contract with immediate effect in writing if the other party seriously breaches its contractual obligations. Written termination includes sending a registered letter with acknowledgment of receipt via postal service, even if it is returned marked as "not sought," "delivery refused," or "moved to an unknown address."

Other Provisions

The Organizer reserves the right to change the prices of the online educational materials listed on the website; however, this does not apply to ongoing contracts that are already in progress.

All content available on the website is the property of the Organizer.

The parties are obligated to cooperate and keep each other informed during the performance of the contract. In the event of a dispute, the parties must primarily attempt to resolve the issue amicably.

The Organizer and the User declare that they have the legal capacity to enter into a contract.

This GTC enters into force on February 9, 2024, and remains in effect until amended or revoked.
